{"id":16419,"date":"2018-05-26T00:44:42","date_gmt":"2018-05-26T00:44:42","guid":{"rendered":"https:\/\/news.nnlm.gov\/pnr\/?p=16419"},"modified":"2026-02-03T18:28:16","modified_gmt":"2026-02-03T18:28:16","slug":"data-flash-what-is-this-gdpr-thing-i-keep-hearing-about","status":"archive","type":"post","link":"https:\/\/news.nnlm.gov\/region_5\/data-flash-what-is-this-gdpr-thing-i-keep-hearing-about\/","title":{"rendered":"Data Flash: What is this GDPR thing I keep hearing about?"},"content":{"rendered":"<p>May 25 begins the era of the GDPR, or, General Data Protection Regulation, a new European program with strong enforcement provisions which sets data protection as a default rather than requiring users to opt-out of entities being allowed to use their data (to put it VERY simplistically).\u00a0 <a href=\"https:\/\/www.pcmag.com\/article\/356899\/gdpr-what-americans-need-to-know\">Why should we in the U.S. pay any attention<\/a> to something applying to European data?\u00a0 Well&#8230;.<\/p>\n<p>&#8211;The coming tide of companies, governments, and others using and combining and potentially misusing our personal data is no longer a swell, it&#8217;s a tsunami (says Tom Wheeler of the <a href=\"https:\/\/www.brookings.edu\/blog\/techtank\/2018\/05\/23\/the-general-data-protection-regulation-sets-privacy-by-default\/\">Brookings Institute)<\/a>.\u00a0 The time to act is now, and Europe&#8217;s action will have ripple effects.\u00a0 So it&#8217;s a good thing to be aware of the GDPR because something like it will be in our lives eventually (even if not coming soon to a theater near you).<\/p>\n<p>&#8211;Many large American companies are already global anyway, and <a href=\"https:\/\/www.forbes.com\/sites\/forbestechcouncil\/2017\/12\/04\/yes-the-gdpr-will-affect-your-u-s-based-business\/#6a084bc16ff2\">they are having to respond<\/a> due to their European presence.\u00a0 <a href=\"https:\/\/www.theguardian.com\/technology\/2018\/may\/21\/what-is-gdpr-and-how-will-it-affect-you\">Facebook and Apple<\/a> are two examples.<\/p>\n<p>&#8211;Even many smaller U.S. companies and organizations, though they don&#8217;t have to protect your data under the GDPR, are <a href=\"https:\/\/www.npr.org\/sections\/alltechconsidered\/2018\/05\/24\/613983268\/a-cheat-sheet-on-europe-s-sweeping-privacy-law\">proactively notifying you<\/a> that they are taking steps to do so (you&#8217;ve probably seen a lot of these notices in your inbox recently&#8211;<em>The New York Times<\/em> <a href=\"https:\/\/www.nytimes.com\/2018\/05\/23\/technology\/personaltech\/what-you-should-look-for-europe-data-law.html\">suggests you read them<\/a>).<\/p>\n<p>&#8211;Last but not least, it&#8217;s a fascinating new conceptualization of our entitlements as online beings!\u00a0 The GDPR arguably &#8220;<a href=\"https:\/\/www.vox.com\/the-big-idea\/2018\/3\/26\/17164022\/gdpr-europe-privacy-rules-facebook-data-protection-eu-cambridge\">enshrines data protection as a fundamental human right<\/a>&#8220;.\u00a0 It moves the discussion about data and our privacy as individuals WAAAAAY forward and in new directions.<\/p>\n<p><a href=\"https:\/\/www.vox.com\/the-big-idea\/2018\/3\/26\/17164022\/gdpr-europe-privacy-rules-facebook-data-protection-eu-cambridge\">This article<\/a>, from <em>Vox<\/em>, puts it well: &#8220;&#8230;Norms are shifting once more. Looking back, we can frame the development of digital behavior into three phases: First, there was a <strong>naivet\u00e9 phase<\/strong>, where consumers didn\u2019t really understand the technology and what it meant. Then there was the <strong>careless phase<\/strong>, where people saw data rights or privacy as either unimportant or an acceptable price of entry to all the good, free stuff.
